Developing the Riverstone Scheduled Lands
UrbanGrowth NSW was appointed under the NSW Paper Subdivisions Legislation as the Relevant Authority for Precinct A Stages 1-3 of the Riverstone Scheduled Lands. As the Relevant Authority, UrbanGrowth NSW is responsible for the preparation of Development Plan (Plan) and, subject to a landowner vote, the co-ordination and delivery of that Plan.
UrbanGrowth NSW worked with landowners in Precinct A (Stages 1-3) to prepare a Development Plan, with a landowner vote (Consent Ballot) on the Plan held in September 2014.
Precinct A (Stages 1-3) Consent Ballot Results
The Consent Ballot on the Development Plan for Precinct A Stages 1-3 of the Riverstone Scheduled Lands was held from 1-29 September 2014.
The statement of results from the returning officer shows that:
- 55% of landowners voted in favour of the Development Plan,
- The 55% of landowners in favour of the Development Plan own 56% of the land area.
- 13 ballots representing 8 landowner groups were received after the ballot closure and were ineligible for counting.

Under Section 3 (2) (g) of Schedule 5 of the Environmental Planning and Assessment Act 1979 the Minister can make a Subdivision Order only if over 60% of landowners who own at least 60% of the land area consent to a Development Plan.
As the result of the ballot, the required majority was not achieved and UrbanGrowth NSW cannot proceed with the Development Plan.
